Small Group & Personal Training Agreement (“Agreement”)

In consideration of my participation in the Small Group & Personal Training Core (LP)’s program(s) (“Program”), I understand that I must purchase a single, package or membership of training session(s). I further affirm as follows:

● I understand that the program is voluntary and that Core (LP)’s personal trainer (“Trainer”) will develop and guide me through my exercise program. I will disclose any and all health history and prescribed medications I am taking, as well as any exercise or diet limitations I am aware of or have been informed of by my doctor. During a Core (LP) workout, if my medications, condition, or medical limitations should change, I will notify Core (LP) and my Trainer. I understand that it is recommended that I have a yearly physical or more frequent physical examination and consultation with my physician as to physical activity and diet so I am aware of what is appropriate for me;

● I understand that a Core (LP) Trainer is not a physician and cannot provide medical advice;

● I understand that I have the complete right to stop or decrease exercise at any time during a session and that it is my obligation to inform the Core (LP)’s Trainer of any symptoms that might indicate a health risk to me, such as fatigue, shortness of breath, or chest discomfort;

● I realize that participation in the Program includes, but is not limited to, exercising, use of exercise equipment, and strenuous exertion, all of which increase heart rate and body temperature;

● I understand that exercise involves certain risk including, but not limited to, serious bones and muscle, including neck and spinal injuries, resulting in complete or partial paralysis, heart attack, stroke, or even death. Slips, falls, and unintended loss of balance could result in muscular, neurological, orthopedic or other bodily injury. I also understand that part of the risk involved in undertaking any activity or program is relative to my own state of fitness or health (physical, mental, or emotional) and to the awareness, care and skill in which I conduct myself in that activity or program; and

● Covid-19 Policy: I understand if I been exposed to or have symptoms of Covid-19, Core (LP) mandates I do not attend any scheduled session.

Knowing the material risks and appreciating, knowing, and reasonably anticipating that other injuries are a possibility, I hereby expressly assume all of the delineated risks of injury, all other possible risk of injury, and even risk of possible death, which could occur by reason of my participation in any/all Core (LP) Programs. I further understand all sales are finals and I am not entitled to any refunds.

By executing this Agreement, I agree that Core (LP), LLC or its successors, assigns, agents, attorneys, directors, officers, parent company, affiliates and/or subsidiaries (also referred to as “Core (LP)”) are hereby released and discharged from any and all liability, demands, losses, medical expenses, lost opportunities, damages or attorneys’ fees and costs stemming from any or all claims including, but not limited to, claims for negligence, defective product, expressed or implied warranty, contribution, and indemnity, and/or claims of negligent first aid, and emergency care, to the broadest extent permitted by applicable law with respect to any adverse impact on health, illness, aggravated pre-existing condition, personal injury and other injury or harm, disability, and/or death, or property damage, arising directly or indirectly from my participation in the Program. I irrevocably and unconditionally, fully and forever waive, release and discharge Core (LP) from any and all claims, demands, actions, causes of actions, obligations, judgments, rights, fees, damages, debts, obligations, liabilities and expenses (inclusive of attorneys’ fees) of any kind whatsoever whether known or unknown, regardless of whether such claim, damage or obligation has occurred or yet to occur. I further agree Core (LP) shall not be liable for any injury or damages sustained by myself or any minor child(ren) under my care, custody, or control, or any fetus or unborn infant, as a result of any and all activities related to participation in the Program. I further agree not to commence legal action in any form or lawsuit against Core (LP) for the claims being released in this Agreement. Despite this waiver and release of liability, if a legal claim, demand or lawsuit is commenced against Core (LP) by myself or my heirs or estate, I agree to indemnify Core (LP) for all attorneys’ fees, losses, damages or cost it may incur as a result of such a claim whether asserted directly or through another person.

I declare that I have read, understand, and agree to the contents of this Core (LP) Agreement in its entirety. I further declare that no oral representations, statements, or inducement apart from the foregoing written agreement have been made. I understand that the Assumption of Risk and Waiver of Liability are intended to be as broad and inclusive as permitted by applicable law and agree that if any portion is held invalid, the remainder will continue in full force and effect.

I declare that I have read, understand, and agree to the contents of this Agreement in its entirety. I further declare that no oral representations, statements, or inducement apart from the foregoing written agreement have been made. I understand that the Assumption of Risk and Waiver of Liability are intended to be as broad and inclusive as permitted under applicable law and agree that if any portion is held invalid, the remainder will continue in full force and effect.
